TERMS AND CONDITIONS
1. GENERAL INFORMATION
This document regulates the terms and conditions of the services offered by Excursiones Marítimas Alicante S.L. (hereinafter, "the Company"), with Tax ID No. B10959716, registered office at C/ Alemania n°3, 03003 - Alicante, telephone: +34 694 44 38 20, email: alicanteboattours@gmail.com, and website: www.alicanteboattours.com.
The Company offers excursions and water activities (banana boating and snorkeling) by speedboat, as well as private speedboat rentals in the port of Alicante. Booking any of our services implies full acceptance of these terms and conditions.
2. RESERVATIONS AND PAYMENTS
To formalize a reservation, full payment must be made through our website, by email, or by phone. No reservation is made without payment. For bank transfer payments, please send proof of payment to: alicanteboattours@gmail.com
The ticket is valid for the specified number of people, for the specified date, time, and excursion.
A minimum of 8 people is required for each excursion. If this number is not met, the client will be contacted to reschedule their trip or receive a refund.
3. CANCELLATION AND MODIFICATION POLICY
The consumer may cancel the contracted services and, depending on the advance notice given, is entitled to the following refund:
If the consumer does not show up at the scheduled departure time, the consumer will not be entitled to any refund of the amount paid, unless otherwise agreed between the parties.
In the event that the company cancels the trip for any reason not attributable to the consumer, the consumer will be entitled to a refund of the amounts paid. This applies even if the group is coming from another country and cannot take the excursion on another date. The consumer is not obligated to pay compensation when the cancellation of the excursion is due to force majeure, meaning circumstances beyond the company's control (including weather conditions), the consequences of which could not have been avoided despite due diligence. In this case, the consumer will receive a voucher for the same amount purchased, to be redeemed at another date during the season.
The consumer is obligated to report any non-compliance or disagreement with the service provided during the trip, either on-site or otherwise, as soon as possible, in writing or in another form that provides proof.
4. SAFETY AND CONDUCT RULES
Clients must follow the crew's instructions at all times and respect established safety rules.
For hygiene reasons, bringing drinks or food on excursions is not permitted.
We recommend not bringing valuables on tours. Excursiones Marítimas Alicante is not responsible for any loss, theft, or breakage.
The company and its crew reserve the right to refuse admission to clients and may not allow boarding to intoxicated individuals, those exhibiting misbehavior, or those who may jeopardize the smooth running of the tour and the safety of other passengers.
The use of illegal substances on board is prohibited.
Minors must be accompanied by an adult (parent, legal guardian). If this is not the case, they must complete the authorization form for minors in active tourism activities, available on the company's website or directly at the office before the tour.
It is important to notify company staff if you have any physical condition, such as pregnancy, back pain, or other medical conditions.
Failure to comply with these rules may result in dismissal from the activity without reimbursement.
5. LIABILITY
The Company is responsible for having all the required documents, permits, insurance, and materials for the proper functioning of the activity.
The Company will not be liable for delays, cancellations, or changes due to force majeure, adverse weather conditions, or safety reasons.
The client participates in the activity at their own risk, exempting the Company from any claims arising from accidents or incidents due to causes beyond its control.
The Company is not responsible for the loss or damage of personal belongings during the activity.
6. DATA PROTECTION
The Company complies with current regulations regarding the protection of personal data. The data provided by clients will be processed in accordance with our Privacy Policy, for the purpose of managing reservations and improving our services.
7. APPLICABLE LAW AND JURISDICTION
Any dispute arising from the interpretation or execution of these terms and conditions shall be subject to Spanish law and the jurisdiction of the courts of Alicante.
